You’ve had an accident, but do you have a claim?

Answer these four questions to determine if you need an attorney.


Someone recently mentioned the interesting description of personal injury lawsuits on Wikipedia, so I checked it out. Like many things on Wikipedia, there were some very helpful things and some suspect things. However, I did find this nugget of knowledge that I’d like to share – a basic 4-part test to determine if your next step following an incident is contacting an attorney.


Let’s say you were in a car accident. Ask yourself these questions to decide if you have a right to make a personal injury claim. Not every accident leads also to a personal injury claim, so these are good guidelines if you are unfortunately involved an accident due to no fault of your own.


1. Did the opposing driver have a duty to act in a reasonable manner and honor all traffic laws when operating their vehicle at the time of the collision?


2. Did the opposing driver breach that duty by acting in an unreasonable manner? The most common complaints are failure to stop / yield, following too closely, distracted driving.


3. Did the opposing driver’s failure to operate their vehicle properly cause you to be injured, and you had to receive medical treatment for injuries caused by the accident?


4. Did you incur medical bills, lost wages and or other monetary losses due to the other driver’s faulty or negligent driving?


If you can answer yes to these main four questions, then it’s quite possible you have a valid personal injury claim.
